SWAN CLEANING SERVICES UPDATE
As you might have heard, Swan Cleaning Services has entered into financial administration.
This is the legal process that occurs when a company is in severe financial difficulties and is unlikely to be able to pay its bills and other debts.
An Administrator is appointed from outside the company to take over the running of the business until decisions can be made about whether or not the company should stay in business.
At this stage it looks likely that Swan Services will be closed down and other companies will take over the contracts on your sites.
WHAT HAPPENS TO CLEANERS WHILE THE
DECISION IS BEING MADE?
In most cases members should continue work as normal until a decision is made. United Voice is already in discussions with the Administrators and building owners about protecting members’ jobs. We will be in constant contact with you throughout our discussions to make sure you are kept up to date.
WHAT HAPPENS TO CLEANERS IF SWAN CLOSES
Normally a new cleaning contractor will be brought in to clean the building. It is United Voice’s position that all members who want to keep their job be allowed to do so. However in some cases the new contractor will attempt to bring in their own cleaners to do the job. Cleaners should ensure they are strong in the union so there is a better chance that jobs can be saved.
WHAT HAPPENS TO CLEANERS’ ENTITLEMENTS
SUCH AS ANNUAL LEAVE BALANCES IF SWAN
In many cases workers lose their entitlements when their employer goes into Administration. However if you are an Australian Citizen or Permanent Resident the Government has protected some of your entitlements in a system called Fair Entitlements Guarantee (FEG). United Voice will assist all members in making claims through FEG for their owed entitlements.
WHAT IF I’M AN INTERNATIONAL STUDENT?
United Voice has been strongly advocating that International Students get the same protections as all cleaners. Despite this, the FEG claim process is only available to Australian Citizens and Permanent Residents and cannot be accessed by international students who have lost entitlements.
United Voice is urgently talking to building owners where International Students clean about paying any short fall in entitlements. As you can imagine, they wont want to do that, however, the stronger we are the more chance that we can achieve that. If you are an International Student, join the union.
It is important for the union to be as strong as possible by ensuring all cleaners are members of the union. United Voice will be talking to cleaning contractors about the best way to ensure that members’ jobs are safe.
